General terms and conditions of the company

1. Scope and general:

The contract language is German. All offers, deliveries, orders and other agreements are subject exclusively to the following terms and conditions. Agreements deviating from this must be in writing. These conditions are also recognized by placing an order or accepting a consignment. Any other terms and conditions apply only in the event that we have acknowledged them in writing. All offers of the products we sell are subject to change until our order is confirmed. An order is only considered complete when we confirm the order in writing or deliver it immediately without confirmation. Partial deliveries are permitted. If, due to force majeure, labor disputes or other unforeseeable events, obstacles regarding the delivery and performance obligations arise, the delivery time will be extended accordingly. If the delivery or service becomes completely or partially impossible or unreasonable due to circumstances of the aforementioned type, we are entitled to withdraw from the contract in whole or in part. This also applies if we are already in default. If our sub-suppliers fail to meet their obligations despite our best efforts, we are entitled to withdraw from the contract. In this case we are ready to assign any claims against the pre-supplier to the customer. The offer is aimed only at buyers who only use the goods in their independent professional, commercial, official or official work. This must be proven to us on request. With the order, the buyer confirms the corresponding use of the goods.

2. Prices and retention of title:

Our prices include VAT at the statutory rate. The prices are valid until further notice. The goods remain the property of
Haaro Friseurbedarf GmbH until final payment.

 

3. Online orders:

The functionality of the Haaro online shop is limited to countries of the European Union as well as Norway and Switzerland. We ask interested parties from other countries to contact us using the contact form.

3.1. Conclusion of contract for online orders

3.1.1 Our product presentation in the Haaro online shop merely represents a non-binding invitation to you to order goods from us.

3.1.2. By submitting the order you submit a binding offer to conclude a purchase contract.

3.1.3. We accept the offer by delivering the goods. The automatically generated email order confirmation does not represent acceptance of the offer, but only documents that we have received the order. The decision whether to accept an order is at our discretion. If we do not carry out an order, we will inform you immediately.

3.1.4 If, during the processing of your order, we find that the products you have ordered are not available, you will be informed of this by email. A contract for the unavailable goods is not concluded. Any payments that have already been made will be refunded to you immediately.

3.1.5 We only sell our goods to fully legally competent persons who have reached the age of 18 and only in quantities customary in the trade.

3.1.6 Maximum order value

The maximum order value per order for payment by credit card / PayPal is € 2,000 and for payment on delivery: € 2,000

3.2 Prices, shipping costs

3.2.1. For orders in our internet shop, the prices listed in the offer at the time of the order apply. The "net prices" without VAT as well as the final price including the legally applicable German VAT and other price components are displayed.

3.2.2 For deliveries outside of Germany, but within the EU:
If the prerequisites for an "intra-Community delivery", which is exempt from VAT in Germany, we do not charge VAT. It is necessary to enter the sales tax identification number. The compliance of the VAT identification number with the company name, legal form and address specified in the order is checked.

3.2.3 The following applies to deliveries outside the EU (third country):
If the requirements for a delivery to a “third country” (Section 6 Paragraph 1 UStG) are met, which are exempt from VAT in Germany, we do not charge VAT. For deliveries outside the countries of the European Union, additional costs may arise when importing into a third country (customs duties, possible customs fees and import sales taxes). These remaining costs are borne by the customer.

3.3 Payment:

The payment of the goods takes place optionally according to the payment methods suggested in the ordering process and under the conditions mentioned there. Haaro Friseurbedarf GmbH reserves the right to carry out the order only against payment in advance in individual cases or if payment is refused by banks or providers of the respective payment method. In this case, the customer can accept this or withdraw from his order. The customer will be charged for costs incurred as a result of the rebooking of a payment transaction due to insufficient funds or due to data incorrectly transmitted by the customer. In the event of a delay in payment, Haaro Friseurbedarf GmbH is entitled to charge default interest at an appropriate amount.

We offer various payment options. You can basically choose between:

3.3.1. Cash on delivery:

We ship by UPS cash on delivery. The invoice amount is to be paid in cash directly to the delivering courier upon receipt of the goods. We charge a cash on delivery fee of € 3.00, which is already included in the invoice amount. There is no additional fee to pay to the messenger. Payment on delivery is only possible for deliveries to Germany.

3.3.2 Prepayment:

If you choose the payment method prepayment, we ask you to transfer the total amount to the specified account. After receipt of payment, the goods will be dispatched immediately.


3.3.3. Paypal:
f you have selected the payment method PayPal, you will be automatically forwarded to PayPal and can confirm your payment there.

3.4 Delivery and delivery times:

The delivery is carried out by the transport company UPS. We reserve the right to refuse delivery if the delivery address is outside the valid delivery area (countries of the European Union as well as Switzerland and Norway), a previous order has not been carried out several times or the customer has a poor credit rating. Delivery to post office boxes and post warehouse addresses is not possible for postal reasons. The delivery times depend on the product. If longer delays occur after an order, the customer will be informed by email and has the right to withdraw from his order or make changes at any time before delivery, unless otherwise agreed. If impossibility is not attributable, Haaro Friseurbedarf GmbH is entitled to withdraw from the contract. From this, the customer can not derive any claims for damages.

3.5 Incorrect delivery and transport damage:

If it is a matter of an incorrectly assembled delivery or transport damage, the costs of the return will be borne by Haaro Friseurbedarf GmbH. In this case, please let us know the order number and the reason for the return so that we can arrange for the goods to be picked up.

 

RIGHT OF WITHDRAWAL

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Haaro Friseurbedarf GmbH, Nümmener Str. 17, 42653 Solingen, Germany, fax: +49 (0) 212 382562-29, email: info@haaro.de) by means of a clear declaration (e.g. a Letters sent by post, fax or email) inform you of your decision to cancel this contract.

To meet the cancellation deadline, it is sufficient for you to send your communication regarding your exercise of the right of cancellation before the cancellation period expires.

Consequences of cancellation

If you cancel this contract, we have made all payments we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

We can refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You have the goods immediately and in any case within fourteen days from the day on which you inform us of the cancellation of this contract to us (Haaro Friseurbedarf GmbH, Nümmener Str. 17, 42653 Solingen, Germany, fax: +49 ( 0) 212 382562-29, email: info@haaro.de) to be returned or handed over. The deadline is met if you send off the goods before the period of fourteen days has expired.You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the nature, properties and functionality of the goods.
There is no right of withdrawal for commercial customers.
END OF REVOCATION

 

Warranty
The statutory warranty obligation is 2 years and begins with the delivery of the goods. During the statutory warranty period, the buyer initially has the right to repair or replacement free of charge. If neither is possible, the buyer can demand a reduction in the purchase price or a reversal of the purchase contract. The guarantee does not apply to the consequences of normal wear and tear or improper use. If there is neither a wrong delivery nor a warranty case, the costs for testing and repair as well as shipping costs incurred for Haaro Friseurbedarf GmbH can be adequately charged to the customer. Haaro Friseurbedarf GmbH can request advance payment from the customer for reimbursement of these costs or offset it against the customer's other claims for reimbursement. To this extent, Haaro Friseurbedarf GmbH also has a right of retention on the checked goods until this cost reimbursement has been secured. The customer is obliged to adequately pack and address the goods for return transport.
